While USJOBS is not responsible for reviewing the information which is hosted on the Site, USJOBS reserves to right to remove any information which violates its policies set forth herein or which USJOBS determines, in its sole discretion, is inconsistent with USJOBSs standards for the Site without prior notice to the user and without refund of any fees paid to USJOBS for use of the Site. Resumes, background information, job postings and other material on the Site may contain inaccuracies or errors. Each user, whether employer or candidate, acknowledges and agrees that it is solely responsible for the form, content and accuracy of any resume, job posting or material contained therein placed by it on the Site. If users choose to "blind" personally identifiable information, it may be viewed by USJOBS Research Specialists and selected employers and, while USJOBS will make every reasonable effort to restrict public access to such information and the information contained in the Contact Information section of the Resume Template, USJOBS does not make any assurances that such information will not be accessed and used by third parties. All risks associated with posting information on the Site, including risks associated with potential unauthorized access to such information and the use of such information, shall be borne solely by the user and USJOBS shall in no way be liable as a result of any unauthorized access to the information posted on the Site or the use of such information. SOME JURISDICTIONS DO NOT ALLOW LIABILITY TO BE LIMITED, SO NOT ALL OF THE ABOVE LIMITATIONS MAY APPLY TO EVERY USER. INDEMNITY The user agrees to indemnify, defend and hold harmless USJOBS, its directors, officers, shareholders, agents, employees and users of the Site from and against any and all claims, liabilities, losses, damages and expenses, including attorneys fees, arising out of or resulting from any and all use of the Site by the user and from any breach of or non-compliance with any of the provisions set forth herein. TERMINATION OF SERVICE Either USJOBS or the user, in its sole discretion, may terminate the users account at any time with or without reason. USJOBS also may, in its sole discretion, suspend a users account at any time with or without reason. In no event will any charges be pro rated. USJOBS may delete all data, files or other information that is stored by the user on the Site upon termination. INTERPRETATION; GOVERNING LAW; CONSENT TO JURISDICTION The provisions set forth herein supersede all other written or oral communications or agreements with regard to the subject matter hereof. If any of these provisions is found to be unenforceable or invalid, the remaining provisions hereof shall be enforceable and valid to the greatest extent permitted by law. These provisions shall be governed by and interpreted in accordance with the laws of The Commonwealth of Massachusetts, without regard to its or any other jurisdictions conflict of laws principles. Users agree that all actions, suits or proceedings arising out of or based upon these provisions or the subject matter hereof shall be brought and maintained exclusively in the state or federal courts located in The Commonwealth of Massachusetts.
