Without limiting the foregoing, the Site may be used only for lawful purposes and in a manner which USJOBS believes, in its sole discretion, is consistent with the rights of USJOBS users and other third parties. The Site may not be used in a manner which would violate any law or infringe any copyright, trademark, trade secret, right of publicity, privacy right or any right of any person or entity or for the purpose of transmitting or storing material which is obscene, libelous or defamatory. Use of the Site for transmitting or storing pornographic material or material that is offensive to the general public (including expressions of bigotry, racism or hatred) is strictly prohibited.

USJOBS is not responsible for the content of the material hosted on the Site. While USJOBS is not responsible for reviewing the information which is hosted on the Site, USJOBS reserves to right to remove any information which violates its policies set forth herein or which USJOBS determines, in its sole discretion, is inconsistent with USJOBS’s standards for the Site without prior notice to the user and without refund of any fees paid to USJOBS for use of the Site.

Resumes, background information, job postings and other material on the Site may contain inaccuracies or errors. USJOBS makes no representations about the accuracy, reliability, completeness or timeliness of the content on the Site.

Each user, whether employer or candidate, acknowledges and agrees that it is solely responsible for the form, content and accuracy of any resume, job posting or material contained therein placed by it on the Site.

USJOBS reserves the right to sell advertising on the Site and directory home pages. The contents of such advertisements shall be determined by USJOBS in its sole discretion. All proceeds of such advertisements shall be for the sole benefit of USJOBS.

The Site may contain links and pointers to other Internet sites maintained by third parties. USJOBS does not operate or control in any respect any information, products or services on such third-party sites. Third-party links and pointers are included solely for the convenience of users, and inclusion does not constitute an endorsement of such sites by USJOBS. Personally identifiable information posted on the Site (other than the information contained in the Contact Information section of the Resume Template) is not confidential and may be viewed by USJOBS and anyone with access to the Site. If users choose to "blind" personally identifiable information, it may be viewed by USJOBS Research Specialists and selected employers and, while USJOBS will make every reasonable effort to restrict public access to such information and the information contained in the Contact Information section of the Resume Template, USJOBS does not make any assurances that such information will not be accessed and used by third parties. All risks associated with posting information on the Site, including risks associated with potential unauthorized access to such information and the use of such information, shall be borne solely by the user and USJOBS shall in no way be liable as a result of any unauthorized access to the information posted on the Site or the use of such information.

Either USJOBS or the user, in its sole discretion, may terminate the user’s account at any time with or without reason. USJOBS also may, in its sole discretion, suspend a user’s account at any time with or without reason. In no event will any charges be pro rated. USJOBS may delete all data, files or other information that is stored by the user on the Site upon termination.

The provisions set forth herein supersede all other written or oral communications or agreements with regard to the subject matter hereof. If any of these provisions is found to be unenforceable or invalid, the remaining provisions hereof shall be enforceable and valid to the greatest extent permitted by law. These provisions shall be governed by and interpreted in accordance with the laws of The Commonwealth of Massachusetts, without regard to its or any other jurisdictions’ conflict of laws principles. Users agree that all actions, suits or proceedings arising out of or based upon these provisions or the subject matter hereof shall be brought and maintained exclusively in the state or federal courts located in The Commonwealth of Massachusetts.
